Wonder if she has a potential lawsuit for this. Because I imagine they expect the pit to support them, and it seems as if they didn't include enough space for the padding. Their negligence caused the woman's injury, so tehy're entirely responsible for her having a rod put into her back. That's not a cheap procedure. It's insanely expensive. If I understand what they were actually doing here she would know that a fall during that activity (It looked like a padded baton battling contents of some sort) was likely, so she might have to take part responsibility for deciding to take part. More importantly she technically wasn't doing the padded baton contest at that moment. She was celebrating and did that massive star jump into the pit and that's what caused the injury. The powers that be at twichcon could say that they didn't tell her to do that and that the padding in the base of the pit was designed to protect people falling off the platforms, not for someone doing "acrobatics" of the platform. I have no law background but I assume she could sue for inadequate padding, lack of safety and proper protocols, better known as negligence and misrepresentation, perhaps. She and anyone else participating likely had to sign a waiver absolving the venue from any lawsuits and damages but I am not sure the validity of waivers. What she has in her favor is the location of the Twitchcon - California - which is the most pro-customer/consumer state in the USA so there are likely a lot of laws that would make it possible for her to sue and win, tbh. Even in the Marines, when we would go against each other during rifle training with the pugil sticks, we wore tons of protective gear. But, they may still be able to get neglect for not properly protecting the pit. Considering the pit is only a foot deep and the floor was concrete, they should have included mats under the foam blocks to better protect their guests. A waiver doesn't excuse lack of safety measures that this foam pit clearly had. It would protect them against people who got hurt from being hit in the gladiatorial fights that were going on and if the pit was properly made, any injuries that would result from falling into it at bad angles. Getting hurt because of safety negligence from the organizers is a different matter entirely because had they bothered to make a proper foam pit this wouldn't have happened. Is Twitchcon culpable or is the vendor who brought this in culpable? Btw, I've see these devices at gymnasiums and birthday parties all the time, I've never been interested in trying. I would assume that the proper twitch organizers would of had to verify it and if they didn't have a safety expert from their staff verify the claims of the pit then they are liable either way. Shes injured and will clearly have that profession affected do to her injuries so that lost income would most likely be included in any lawsuit taken or compensation given to her.
